Ruth Ann Daniels

Partner

Ruth Ann Daniels has been a trial lawyer for more than twenty years and specializes in employment litigation for management, defending companies against claims of sexual harassment, age discrimination, racial discrimination, sex discrimination and wrongful termination, and in claims involving alleged violations of the Americans with Disabilities Act and the Family Medical Leave Act. Ruth Ann also has been involved in defending multi-party and class action litigation matters, particularly with respect to wage and hour claims made under the Fair Labor and Standards Act.

Representative Matters

Obtained a favorable opinion from the Texas Supreme Court in In re AutoNation, Inc., 228 S.W.3d 663 (2007), which held that a forum selection clause in a covenant not to compete, designating another state as the appropriate forum, is enforceable in Texas.
Obtained favorable jury verdicts or arbitration awards, completely vindicating her clients, in:

- Jennifer Swinford v. Houston Auto Imports North, Ltd. et al.(pregnancy discrimination)

- Janice L. Mace v. Countrywide Home Loans, Inc. (age discrimination and FLSA)

- Joseph Capasso v. Bankston Ford of Frisco, Ltd. Co. (national original discrimination)

- Carter Burress vs. Fred Oakley Motors, Inc., et al (age and disability discrimination)

- Sheri Reyes v. Countrywide Home Loans, Inc. (unpaid bonuses)
