Wallace and Baum Win FMLA, ADA Suit for Nordstrom
January 2009The firm is pleased to congratulate Jay Wallace and Michael Baum on their recent win in an employment case for Nordstrom. The suit, which was submitted to an arbitrator, involved allegations that Nordstrom had retaliated against an employee it had terminated for having taken intermittent leave under the Family Medical Leave Act and for discriminating against the employee on the basis of a disability in violation of the Americans with Disabilities Act. The arbitrator ruled Nordstrom had not violated either the FMLA or the ADA and that neither the Plaintiff’s having taken leave nor his alleged disability were a factor in Nordstrom’s decision to terminate. This win was Jay and Michael’s third of 2008 -- they also won two jury trials, one of which was for Target Corporation.
